Privacy Policy

This privacy policy (“Privacy Policy”, “Policy”) describes the practices of Talemio Enterprises Inc., dba talemio unique gifts (“talemio”, “we”, “us”, “our”), with respect to our collection, use, storage and disclosure of Personal Information (as defined in section 1) provided to us from visitors using the talemio website (https://talemio.com) (the “Website“) and purchasing our Products and Services (both as defined in section 2). This Policy also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. 

When you complete the purchase of any of our Products and Services on the Website, you are agreeing to this Privacy Policy. By providing Personal Information to us through the Website, you consent to the use of your Personal Information as described in this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not provide any Personal Information to us. Please review section 13 of this Privacy Policy if you wish to withdraw your consent to our collection and/or usage of your Personal Information.

1. What is Personal Information

For the purposes of this Policy, “Personal Information” means information about:

  • contact information such as name, email address, mailing address, phone number of yourself as the purchaser of our Product(s);
  • contact information such as name, email address, address, location and phone number of the intended recipient(s) of our Product(s) (the “Recipient”);
  • billing information such as credit card number, payment history, and billing and shipping address;
  • order and payment history;
  • unique identifiers such as user name, account number, password;
  • user content generated by you, such as audio, video, text and images as created or provided by you on our Website as comments to the information about Products; and
  • any other communication to us provided by you, including the questions you ask and feedback you provide

We will only collect, use or disclose Personal Information in accordance with this Policy, and in accordance with laws, regulations and statutes applicable to the collection, use and disclosure of your Personal Information by us (the “Applicable Privacy Laws”).

We also automatically gather “Non-Personal Information” about your device such as your IP address, browser type, referring/exit pages, operating system, web pages and links that you view and accessed on our Website, the date and length of time you visited the Website and used our Services, the Internet address of the website from which you linked directly to the Website, content you downloaded from our Website, as well as which aspects of our performance metric indicators available with our technology or our licensee’s products you prefer using.

2. Products and Services

For the purposes of this Policy, “Products” means the items we offer for sale, including, without limitation, the following items:

  • Children’s Comfort Gift Box (DELUXE & VALUE);
  • Youth’s Comfort Gift Box (DELUXE & VALUE);
  • Women’s Comfort Gift Box (DELUXE & VALUE);
  • Men’s Comfort Gift Box (DELUXE & VALUE);
  • Women’s Senior Comfort Gift Box (DELUXE); and
  • Men’s Senior Comfort Gift Box (DELUXE).

 “Services” means the services we provide ancillary to and in support of your purchase of our Products, including, without limitation:

  • designing, assembling, packaging and otherwise preparing the Products for delivery;
  • delivering the purchased Products to the Recipient(s);
  • notifying and communicating with you as the purchaser of the Products with respect to the order and delivery status of the Products;
  • gathering more information in order to complete the purchase and delivery of your orders; and
  • responding to customer service requests, questions, feedback or concerns.

3. Your Consent

Personal Information as identified in this Policy and as may be further identified at the time of collection. 

Other times, you may provide your implied consent to our collection, use or disclosure of Personal Information when we can reasonably conclude that you have given consent by some action you have previously taken or an action you have already decided not to take.  Generally, this occurs where the purpose for the use of your Personal Information would be reasonably apparent to you – for example, when you provide us with your Personal Information for the purposes of purchasing our Products and receiving our Services. 

4. Use of Personal Information

We may use your Personal Information, in combination with your Non-Personal Information (collectively, “information”), for a variety of business purposes, including, without limitation:  

  • send order confirmations or receipts for the Products and Services purchased;
  • complete your purchase of our Products;
  • provide the Services to you;
  • send you information about new Products and Services we offer;
  • administer your account;
  • carry out promotions and marketing communications;
  • send you invitations to provide reviews or feedback of your customer experience;
  • improve our service and marketing efforts; and
  • for other purposes as described in this Policy.

5. How We Use Your Information

As permitted by Applicable Privacy Law, we use your information, including your Personal Information, for the following purposes:

  • to tailor the content and information that we may send, deliver, distribute and display to you and to otherwise personalize your experiences while using the Website;
  • to our third-party partners, affiliates, subsidiaries for direct marketing or promotional purposes and where necessary, with your consent, to provide them with information such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you, including third party products and services.  We also may use the information that we learn about you to assist us in advertising our services on third party websites. Information on how to opt-out of receiving these promotional emails is provided near the end of this Policy under section 13;
  • for research and analytical purposes, such as to better understand how visitors access and use the Website, both on an aggregated and individualized basis, and to study and explore the ways to improve the Website;
  • for training purposes;
  • to administer surveys and questionnaires;
  • to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena;
  • in the context of a merger or acquisition, if some or all of our assets are transferred to another company, or as part of a bankruptcy proceeding;
  • where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of this Policy, or as evidence in litigation in which talemio is involved;
  • to authenticate your identity;
  • to allow you to participate in our contests, and to administer those contests;
  • to monitor your compliance with any of your agreements with us;
  • to collect debts owed to us; and
  • for other purposes we may inform you about from time-to-time.

Please also note that we may transfer your Personal Information across provincial or national borders to fulfil any of the above purposes, including to service providers located in the United States and other jurisdictions outside of Canada who may be subject to applicable disclosure laws in those jurisdictions. You may contact us (our contact information is provided below) to obtain information about our policies and practices regarding our transfer of data or use of service providers outside of Canada, or to ask questions about the collection, use, disclosure or storage of Personal Information outside of Canada.

6. Disclosing, Retaining and Destroying Personal Information

We will only use and disclose your Personal Information for the purposes set out in this Policy and as authorized by law.  We will keep Personal Information used to purchase our Products and Services for at least one year after using it to complete your purchase order, unless otherwise permitted or required by law.

We will destroy, erase or make anonymous documents or other records containing Personal Information as soon as it is reasonable to assume that the original purpose is no longer being served by retention of the information and retention is no longer necessary for legal or business purposes.  We will take due care when destroying Personal Information so as to prevent unauthorized access to the information.

7. Other Information We Collect Automatically

In some cases, we automatically collect information about your use of certain Services and of our Website through cookies, web beacons, and other technologies, including technologies designed for mobile apps. 

  1. The Website

You do not need to create an account with talemio to check us out. However, to complete the purchase of a Product, you are required to provide us with certain information, including Personal Information. When using the Website, we may also collect your Non-Personal Information.

  • Our Use of Cookies and Other Tracking Mechanisms

We and our third-party service providers use cookies and other tracking mechanisms to track information about your use of the Website. For example, cookies enhance the convenience and use of the Services. The information provided through cookies is used to recognize you as a previous user of our Service, to offer personalized content and information for your use, to track your activity on the Website, to respond to your needs, and to otherwise streamline your experience.  We may combine this information with Personal Information we collect from you (and our third-party service providers may do so on our behalf). You may choose to decline cookies if your browser permits, but doing so may affect your use of the Service and your ability to access certain features of the Service or engage in transactions through the Service.

8. Third-Party Ad Networks

We use third parties such as network advertisers to serve advertisements on third-party websites or other media (e.g., social networking platforms). This enables us and these third parties to target advertisements to you for products and services in which you might be interested. Third-party ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third-party cookies and other technologies are governed by each third party’s specific privacy policy, not this one. We may provide these third-party advertisers with information, including Personal Information, about you.

In Canada, visitors may opt out of many third-party ad networks. You may visit the Digital Advertising Alliance (“DAA“) Consumer Choice Page for information about opting out of interest-based advertising and other information. You may also visit the Network Advertising Initiative (“NAI“) Consumer Opt-Out Page for information about opting out of interest-based advertising and their choices regarding having information used by NAI members.

Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through the Website.  Additional information is available on the DAA’s website at www.aboutads.info or the NAI’s website at www.networkadvertising.org.

9. Security of Personal Information

We have implemented commercially reasonable precautions to protect the information we collect from loss, misuse, unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our best efforts to protect your Personal Information, no data security measures can guarantee security.

We may also process or transfer your information to jurisdictions outside of your home country where privacy laws may not be as protective. We take appropriate measures to ensure that your Personal Information remains secure when it is transferred outside of your home country, in accordance with applicable privacy laws.

10. Access to My Personal Information

Upon providing written request to talemio in accordance with section 15, we will provide you with your information under our control, information about the ways in which that information is being used and a description of the individuals and organizations to whom that information has been disclosed. We will make that information available within 30 days of receiving the written request or provide written notice to you if additional time is required to fulfil the request.

In some situations, we may not be able to provide access to certain information under our control, including, without limitation situations in which such disclosure would reveal Personal Information about another individual, the Personal Information is protected by solicitor/client privilege, the information was collected for the purpose of an investigation or where disclosure of the information would reveal confidential commercial information that, if disclosed could harm our competitive position. We may also be prevented by law from providing access to certain Personal Information. When an access request is refused, we will notify you in writing, document the reasons for such refusal and outline further steps which are available to you.

11. Updates or Changes to Privacy Policy

Our Policy is current as of the Effective Date set forth below. We may change the Policy from time to time, so please be sure to check back periodically. We will post any changes to the Policy on the Website. If we make any changes to the Policy that materially affect our practices with regard to the Personal Information we have previously collected from you, we will endeavor to provide you with notice in advance of such change by highlighting the change in the Policy on the Website.

12. Withdrawing Your Consent

You may notify us at any time that you wish to withdraw or change your consent to our use and disclosure or your information.  We will accommodate your request subject to legal and contractual restrictions. 

If you receive emails from us, we will provide a link in the email which you can use to unsubscribe from that mailing list, or you may contact us at [email protected].

You may choose not to provide us with your Personal Information. However, if you make this choice we may not be able to provide you with certain Services for which that information is necessary or certain information that you request.  Please speak with talemio staff to determine how this may affect our ability to provide you with Services.  

13. Privacy of Minors

If we discover that Personal Information has been provided by a person who is under the age of majority in the Province of British Columbia, talemio reserves the right to delete such information.
