Terms and Conditions

Please read these Terms and Conditions carefully before purchasing the products on our website. Please also refer to our Privacy Policy, which will form part of our agreement with you.

Article 1 – Interpretation

1.1 Definitions

In these Terms:

“Agent” means any of talemio’s staff, employees, officers, directors, contractors, agents, representatives or assigns;

“Privacy Policy” means the privacy policy published on the Website which governs talemio’s use of the personal information that you provide to talemio when competing the Purchase of the Products and Services;  

“Products” means the giftboxes listed, depicted and described on the Website, including without limitation:

  • Children’s Comfort Gift Box (DELUXE & VALUE);
  • Youth’s Comfort Gift Box (DELUXE & VALUE);
  • Women’s Comfort Gift Box (DELUXE & VALUE);
  • Men’s Comfort Gift Box (DELUXE & VALUE);
  • Women’s Senior Comfort Gift Box (DELUXE); and
  • Men’s Senior Comfort Gift Box (DELUXE);

“Purchase” means doing any of the following:

  • clicking “Place order” on the Website, or selecting whichever other phrase, button or option that prompts an order confirmation page; or
  • entering and submitting one’s credit card information on the Website;

“Services” means the services that talemio provides to you in respect of and in support of your Purchase of the Products, which services include without limitation:  

  • designing, assembling, packaging and otherwise preparing the Products for delivery;
  • delivering the purchased Products to intended recipients;  
  • notifying and communicating with you, as the purchaser of the Products, with respect to the order and delivery status of the Products;
  • gathering more information from you in order to complete and deliver your orders; and
  • responding to customer service requests, questions, feedback or concerns;

“talemio” has the meaning ascribed to in section 2 of these Terms;

“Terms” means these Terms and Conditions of Purchase; and

“Website” means talemio’s website (https://talemio.com/).

1.2 Interpretation

In these Terms:

  • all references to a designated “section” or other subdivision are to the designated section or other subdivision of these Terms;
    • the headings are for convenience only and do not form a part of these Terms and are not intended to interpret, define or limit the scope, extent or intent of these Terms; and
    • the singular of any term includes the plural, and vice versa; any reference to the masculine, feminine or neuter genders, as the case may be, includes a reference to each of the masculine,
    • feminine or neuter genders, as the case may be, and, where applicable, a corporation; the word “or” is not exclusive and the word “including” is not limiting whether or not non‑limiting language is used with reference thereto.

1.3 Governing Law

These Terms and all matters arising hereunder will be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein.

Article 2 – Overview

2.1 talemio

The terms “we,” “us,” and “our” in these Terms refer to Talemio Enterprises Inc. dba talemio unique gifts (“talemio”), also the vendor with respect to the Products and Services provided under the scope of these Terms. 

2.2 Terms & Privacy Policy

Upon completing your Purchase, you agree to receive the delivery of the ordered Products and Services and you agree to enter into a legally binding agreement with us that is subject to these Terms as well as our Privacy Policy.

2.3 Updates

Please note that we reserve the right to modify our Products and Services as well as to update the Privacy Policy and these Terms from time to time.

Article 3 – Your Purchase

3.1 Purchase is Final

Upon completing your Purchase, you agree to pay us the total purchase price as stated on the Website, including the price of the Product(s) ordered and the applicable delivery fees and taxes. Your Purchase is final, and other than as expressly set out in these Terms, we do not provide refunds for any reason – including if you change your mind about your Purchase.

3.2 Refunds

We do not provide refunds if you change your mind. If our Products or Services are no longer suited for your purposes, you may cancel your Purchase, but we do not provide refunds for this reason. It is your responsibility to ensure that our Products and Services meet your needs before you make a Purchase, by either considering the description of the Products and Services on the Website or by contacting us with your inquiries directly. You are able to reach out to us with messages and questions on the Website.

We provide refunds if the Products are not delivered to the intended recipient(s), at the address that you provide in your order, within a reasonable time of the Purchase.

3.3 Your Credit Card Provider

Your Purchase may be made on the Website by credit card. When you make your Purchase through the Website, you may be subject to the additional terms and conditions of your credit card provider that specifically applies to your Purchase. For more information regarding the terms and conditions that may apply, please contact your credit card provider. You release and agree to not assert claims against us or our Agents with respect to any damages that you incur as a result of application of terms and conditions imposed by your credit card provider.

Article 4 – Disclaimer

4.1 No Representations or Warranties

When you make a Purchase, you agree that talemio has not made any express or implied representations or warranties about the purchased Products and Services, including without limitation, warranties of quality, performance, non-infringement, merchantability or fitness for any particular purpose.

4.2 No Guarantees

Talemio has not provided any guarantees as to any future outcomes of any kind that may be derived as a result of your use of our Products and Services, and if any comments about such outcomes were made by an Agent, they were expressions of the Agent’s personal opinion only. Testimonials, reviews or comments published on the Website about our Products and Services are only examples of other customers’ experience and their experience only. There can be no assurance as to any particular outcome based on your purchase of the Products and Services.

4.3 Handmade Items

You understand and acknowledge that, as part of your Agreement herein with talemio, some items in the Products are handmade and one of a kind. You accept and agree that handmade items built from the same artistic design may still look different due to the nature of the creative process for such items and the dye or materials used. No two handmade items will be precisely the same, and these inconsistencies are not product flaws.

4.4 Safety

Please be advised that as a matter of policy, some items in the Products curated by talemio (including without limitation an item named “Worry Gobbler”) are not intended for the use of children under three (3) years old. Some items in the Products may contain small parts which may be considered as choking hazards for children below three (3) years old.

You understand and acknowledge that, as part of your Agreement herein with talemio, it is the responsibility of the parent(s) or legal guardian(s) of the child who receives the purchased Product(s) to select and determine the appropriate and suitable items for the child’s safe consumption and use.
